1. Agreement & Business Identity

These Terms and Conditions ("Terms") constitute a legally binding agreement between you ("User", "Customer", or "Subscriber") and FormLynk ("Company", "we", "our", or "us"), regarding your access to and use of the FormLynk web applications, developer APIs, customer console, and cloud ingestion engine hosted at formlynk.com and its subdomains.

By registering an account, generating API credentials, purchasing a subscription plan, or submitting forms to our endpoint, you accept and agree to be bound by these Terms.

2. Scope of Services & Digital Fulfillment

FormLynk provides a cloud-hosted, headless Software-as-a-Service (SaaS) platform for capturing web form submissions, executing validation rules, mitigating spam via honeypots, dispatching asynchronous email notifications, and synchronizing data with webhooks.

All FormLynk services are delivered 100% digitally. Upon successful account registration or plan upgrade verification via our authorized payment processor, access to increased submission limits, project slots, and API keys is granted automatically within seconds.

3. Acceptable Use Policy & Anti-Abuse Rules

You agree to use FormLynk exclusively for lawful web form processing. You expressly agree NOT to:

• Use FormLynk for unauthorized bulk email distribution, phishing attacks, credential harvesting, or spam campaigns.
• Collect sensitive financial data (such as raw credit/debit card numbers, CVV codes, UPI PINs, or netbanking passwords) into unencrypted text fields.
• Upload or transmit malware, viruses, trojans, ransomware, or executable payload files.
• Attempt to circumvent API rate limits, origin domain whitelisting, honeypots, or server security barriers.
• Impersonate another entity or falsify submission origin headers.

Violation of the Acceptable Use Policy results in immediate account suspension, API key revocation, and forfeiture of any prepaid fees.

4. Subscriptions, Pricing, Currency & Payments

FormLynk offers tiered service plans (Hobby/Starter, Developer/Pro, Agency/Business, and Enterprise). Full details of quotas, features, and pricing are published transparently on our Pricing Page.

• Currency: Pricing is denominated and billed in Indian Rupees (INR - ₹) for Indian customers, and US Dollars (USD - $) for international customers.
• Taxes: Prices displayed are exclusive or inclusive of applicable GST / statutory taxes as itemized before checkout.
• Payment Processing: Online payments are securely processed through our authorized payment partner, Razorpay. We accept UPI, Credit/Debit Cards, NetBanking, and supported digital wallets. We do not store raw card numbers or payment credentials on our servers.
• Billing Cycles: Paid plans are offered on monthly and annual billing cycles. Subscriptions automatically renew at the end of each billing cycle unless cancelled prior to the renewal date.

5. Cancellation & Refund Policy

You may cancel your subscription at any time via your account settings. Cancellation stops future recurring charges while your access remains active through the remainder of the current billing cycle.

6. Intellectual Property & Data Ownership

You retain 100% ownership of your form submissions, recipient contact lists, and uploaded attachments. FormLynk retains all rights, title, and interest in and to the FormLynk brand, codebase, API architecture, visual designs, and documentation.

7. Limitation of Liability & Governing Law

FormLynk services are provided on an "AS IS" and "AS AVAILABLE" basis. In no event shall FormLynk be liable for indirect, incidental, special, or consequential damages resulting from third-party mailer outages (e.g. custom SMTP providers), internet routing interruptions, or unauthorized access to customer systems.

These Terms shall be governed by and construed in accordance with the laws of India. Any disputes arising in connection with these Terms shall be subject to the exclusive jurisdiction of the competent courts in India.
